Official Rules



The "Cheer & Steer" Sweepstakes (the "Sweepstakes") begins at 12:00 a.m. Eastern Time ("ET") on August 27, 2013 and ends at 11:59 p.m. ET on December 2, 2013 (the "Sweepstakes Period").


The Sweepstakes is only open to legal permanent United States residents residing in Alabama, Florida, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Virginia, who are 18 years of age or older with a unique valid Social Security number at the time of entry. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of W.S. Badcock Corporation (the "Sponsor"), its subsidiaries, and each of its respective parent companies, franchisees, affiliates, contractors, consultants, legal counsel, public relations, subsidiaries, distributors, sales representatives, retailers, website providers, webmasters, advertising and promotional, fulfillment, and marketing agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including but not limited to, National Sweepstakes Company, LLC (the "Sweepstakes Administrator") herein (the "Sweepstakes Entities"), are not eligible to participate. Sweepstakes is void outside the states of Alabama, Florida, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Virginia and wherever else restricted or prohibited by law.


There are two (2) ways to enter the Sweepstakes.

  1. Store: Visit a participating Badcock Home Furniture & more location ("Store") and complete the Official Entry Form in its entirety to include your full name, physical address, city, state, zip code, date of birth, phone number, and email address (if any). Then submit the completed entry form by mailing to: "Cheer & Steer" Sweepstakes, PO Box 10310, Rochester, NY 14610. In the event that supply of entry forms is depleted at the Store, you may enter by submitting a 3"x5" index card hand-printed with the same information as above. All Store entries must be postmarked by December 2, 2013 and received by December 10, 2013. Limit one (1) entry per envelope per day per person, mailed separately. The Sponsor is not responsible for lost, late, misdirected, illegible, insufficient postage, or damaged mailed entries.

  2. Online: Visit during the Sweepstakes Period and follow the link to the Sweepstakes Registration Page. Online entrants must check the box to agree to the Official Rules of the Sweepstakes and then complete and submit the Official Online Entry Form, in its entirety, including your full name, physical address, city, state, zip code, e-mail address and date of birth. In order for an online entry to be valid, entrant must have a valid e-mail address, must have checked the box to agree with the Official Rules of the Sweepstakes, and clicked the "submit" button. All online entries must be submitted by 11:59 pm ET on December 2, 2013. Limit of one (1) entry per person/e-mail address per day.
    In the event of a dispute regarding the identity of the person submitting an online entry, the online entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential winners may be required to show proof of being the authorized account holder.

Regardless of the method of entry, there is a limit of one (1) entry per person/e-mail address per day during the Sweepstakes Period. You must complete all required information to be eligible to enter to win a prize. Entries having incomplete information will be disqualified and ineligible to win. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, and/or any other methods, including, but not limited to, automated entry, will void that entrant’s entries and that entrant may be disqualified from the Sweepstakes. Multiple entrants are not permitted to share the same email address. Neither the Sponsor nor Sweepstakes Administrator will verify receipt of entries for entrants. All entries submitted become the sole property of Sponsor and will not be returned.


On or about December 13, 2013, prize winners will be selected in a random drawing conducted under the supervision of the Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these official rules, and are final and binding in all respects. Odds of winning depend upon the total number of entries received.


There is one (1) Grand Prize, one (1) First Prize and one (1) Second Prize to be awarded (the "Prizes").

  1. GRAND PRIZE: One (1) Grand Prize of a 2013 Ford Mustang V6 Coupe, having a Manufacturer Suggested Retail Price (the "MSRP") of approximately $26,000 will be awarded (the "Grand Prize Car") (Vehicle Color, Options and Accessories to be determined at the sole discretion of the Sponsor). Grand Prize Car winner will also receive up to $4,000 to be used towards his/her registration, license, title and sales tax fees. Grand Prize Car winner must have and provide a valid Driver’s License and provide proof of existing Car Insurance Coverage (Comprehensive or Liability) at time of delivery. Grand Prize Car winner will be solely responsible for any applicable registration, license, title and insurance fees, all taxes (federal, state, local and/or income) and any expenses not listed herein related to the acceptance and use of the Grand Prize Car for any value beyond the $4,000. Sponsor does not make, nor is Sponsor in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize Car, including but not limited to its quality, fitness for purpose or mechanical condition; the only representation/warranty/guarantee that may be provided relative to the Grand Prize Car, if any, are those of the manufacturer and/or dealer. Grand Prize Car winner must accept delivery of vehicle at a dealership to be determined by Sponsor within thirty (30) days of notification that dealership has received vehicle. Grand Prize Car winner is required to comply with any and all applicable federal, state and local laws, rules and regulations including, but not limited to licensing and insurance requirements. Any taxes imposed on the income of the Grand Prize Car winner as a result of winning the Grand Prize Car and all other expenses not specifically mentioned herein as part of the Grand Prize Car are solely the responsibility of the Grand Prize Car winner. Total ARV of the Grand Prize Car is $30,000. Any difference between the stated MSRP of the vehicle and the ARV of the actual value will not be awarded.

  2. First PRIZE: One (1) First Prize of a trip for two (2) to Super Bowl XLVIII from January 31, 2014 to February 3, 2014 (the "First Prize Trip"). The First Prize Trip includes: i) roundtrip coach-class airfare for First Prize Trip Winner and guest between a major metropolitan city airport in the US closest to the First Prize Trip Winner’s residence and New York from January 31, 2014 to February 3, 2014 for the Super Bowl, ii) three (3) nights hotel accommodations (one (1) standard room double occupancy), iii) two (2) Upper level Super Bowl Tickets, iv) Breakfast daily, v) Motor Coach Transportation to and from the stadium, vi) Chalk Talk Cocktail Event Hosted by NFL, vii) on-site management team and personal access to concierge and vii) souvenir gift bag. Total ARV of the First Prize Trip is $12,700.
  3. First Prize Trip must be taken from January 31, 2014 to February 3, 2014. If First Prize Trip Winner is unable to travel during those dates than First Prize Trip will be forfeited. First Prize Trip subject to availability. Certain restrictions and blackout dates apply. Travel must be roundtrip. Travel is not eligible for frequent flyer program credit. Sponsor is not responsible for airlines cancellations or delays. All expenses and incidental travel costs not expressly stated in the First Prize Trip description above, including but not limited to, transportation between the First Prize Trip Winner’s home and the departure airport, meals, hotel room service, laundry service, alcoholic beverages, merchandise/souvenirs, local and long distance telephone calls, additional ground transportation, tips/gratuities, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of the First Prize Trip winner. Any taxes imposed on the income of the First Prize Trip winner as a result of winning the First Prize Trip and all other expenses not specifically mentioned herein as part of the First Prize Trip are solely the responsibility of the First Prize Trip winner. All travelers must possess required travel documents (e.g. valid government-issued photo I.D.) prior to departure. Travel restrictions, conditions and limitations may apply. The actual retail value of the First Prize Trip will vary based upon point of departure for airfare fees. No compensation will be awarded to the First Prize Trip winner if the actual retail value is less than the stated ARV.

  4. SECOND PRIZE: One (1) Second Prize of a $1,000 shopping spree to a Badcock Home Furniture & more location will be awarded. The Second Prize will be awarded as a gift card or voucher from W.S. Badcock Corporation. The ARV of the Second Prize is $1,000.

    Names of prize manufacturers are used solely for the purposes of identifications of the prize. No endorsement, authorization, sponsorship, or approval from Ford or NFL® for this Sweepstakes is intended or implied.


Limit of one (1) prize per person/household. The value of the Prizes may be taxable as income and Prize winners are solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the Prize. The Sweepstakes Administrator must report the value of the Prize to the Internal Revenue Service in the year the Prize is received by the Prize winner and will be reported to the Prize winner and the Internal Revenue Service in the form of a Form 1099. No transfer or substitution of a Prize is allowed except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value if Prize becomes unavailable due to reasons beyond the control of the Sponsor. Sponsor will not replace any lost or stolen prizes.


Potential Prize winners will be notified via email/mail or any other available contact sources that the Prize winner has provided on their Official Entry Form approximately five (5) business days from the drawing date. Except where prohibited, potential Prize winners will be required to sign and return to Sweepstakes Administrator, within the date and/or time indicated in the notification letter, an Eligibility and Release of Liability and Public Release Form, a W-9 from, and a Travel Companion Waiver Release Form (if applicable) (the "Paperwork") in order to claim their Prize. If the potential Prize winner fails to return the Paperwork within that time frame, or is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential Prize winner will be disqualified. If the Prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate Prize winner will be selected. All federal, state, provincial or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of the Prize winner. Except where prohibited by law, the Prize winner’s entry and acceptance of the Prize constitutes permission for the Sweepstakes Entities to use said winner’s name, photograph, likeness, statements, biographical information and voice on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.


By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal. Sponsor reserves the right to disqualify permanently from this Sweepstakes any entrant it believes has violated these Official Rules and verify eligibility of entrants. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Sweepstakes, except as expressly set forth in these Official Rules. Neither Sponsor nor any Sweepstakes Entity is responsible for any online entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. By participating in this Sweepstakes, entrants, and winners release the Sponsor and each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All Sweepstakes materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Sponsor. In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or this Sweepstakes, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes. Winning a prize constitutes permission for Sponsor and its agencies to use winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this promotion only, without further compensation, unless prohibited by law. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date to award the Prizes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.


By participating, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and each and all of the Sweepstakes Entities from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity, including traveling to and from any Prize-related activity, in this Sweepstakes or any claims based on publicity rights, defamation or invasion of privacy or merchandise delivery. Upon delivery of the Prize to the winner, Sponsor will be deemed to have awarded the Prize to the winner with the winner assuming full responsibility of the Prize.


By participating, where allowed by law, entrants agree that the Sponsor and Sweepstakes Entities may use winner’s name, picture, portrait, likeness and voice for advertising and promotional purposes without further compensation. Personal information collected from entrants which is disclosed to Sponsor will be subject to the Sponsor’s Privacy Policy located at Submitting an entry constitutes your consent to the terms of this Privacy Policy.


By entering the Sweepstakes, each entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out-of-pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INSEQUENTIAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY. All issues or questions concerning the construction, validity, interpretation and enforceability of theses Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York, without regard to New York’s conflict of laws principles with venue residing in the state of federal courts located in Monroe County, New York.

Governing Law / Venue

You agree that this agreement and your use of this Site are governed by the laws of the State of Florida, USA. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in Polk County, Florida, USA in all disputes (a) arising out of, relating to, or concerning this Site and/or this Agreement, (b) in which this Site and/or this agreement is an issue or a material fact, or (c) in which this Site and/or this agreement is referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization. Use of this Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this agreement, including, without limitation, this paragraph and the warranty disclaimers and liability exclusions above. Badcock has endeavored to comply with all legal requirements known to it in creating and maintaining this Site but makes no representation that Materials on this Site are appropriate or available for use in any particular jurisdiction. Use of this Site is unauthorized in any jurisdiction where all or any portion of this Site may violate any legal requirements, and you agree not to access this Site in any such jurisdiction. You are responsible for compliance with applicable laws.

Any claim, dispute or controversy arising out of, relating to or concerning this Site and/or this agreement shall be decided by binding arbitration in accordance with the Rules of the American Arbitration Association, and any such arbitration proceedings shall be brought and held in Polk County, Florida, USA. The decisions of the arbitrators shall be binding and conclusive upon all parties involved, and judgment upon any award of the arbitrators may be entered by any court having competent jurisdiction. This provision shall be specifically enforceable in any court of competent jurisdiction.

Badcock's performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement is in derogation of Badcock's right to comply with law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by Badcock with respect to such use.

Waiver and Severability and Entire Agreement

Waiver: Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Severability: If all or any part of this Agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Agreement shall govern such use.

Entire Agreement: This Agreement represents the complete agreement between the parties and supersedes all prior agreements and representations between them.

Independent Contractor and Modification

Independent Contractor: You agree that no joint venture, partnership, employment or agency relationship exists between you and us as a result of this Agreement or your use of this Site.

Modification: No modification of this Agreement shall be effective unless it is authored and/or signed by Badcock. A printed version of this Agreement and/or of any notice given by us in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement or your use of this Site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by us in printed form.
